3-Year Statute of Limitations (Most Cases)

Auto accidents, truck accidents, pedestrian accidents, slip-falls, premises liability, dog bites, construction accidents (Labor Law), general negligence - ALL have 3 years from date of injury to file lawsuit in Richmond County Supreme Court (18 Richmond Terrace, Staten Island, NY 10301).

Example: Injured in Hylan Boulevard car crash on January 15, 2023 → lawsuit must be filed by January 15, 2026. If you file January 16, 2026, case DISMISSED - you lose all rights permanently.

2.5-Year Medical Malpractice Statute

Medical malpractice cases against SIUH, RUMC, or any Staten Island doctor/hospital have 2.5 years from date of malpractice OR from end of continuous treatment (whichever is later). Requires Certificate of Merit from medical expert before filing.
